国际笔会狱中作家委员会抗议对网论家、作家兼记者黄金秋(清水君)的重判。黄金秋于2004年9月27日被以颠覆国家政权罪判处十二年徒刑,他自2003年9月13日被拘留,并遭封闭监禁直到2004年1月。国际笔会认为,黄金秋遭监禁仅因他和平地表达其观点,因此违反了《联合国人权宣言》第19条。我们呼吁立即无条件地释放黄金秋。

根据国际笔会的信息,知名网论家、作家兼记者黄金秋因在互联网上发表大量文章,于2004年9月27日被常州市中级人民法院以颠覆国家政权罪判处十二年徒刑。黄金秋自2003年9月13日被拘留,但他的被捕直到2003年12月中旬才被报道,而且在海外中文媒体以外罕见发表。中国当局只到2004年1月才正式承认他在押。

黄金秋于1974年出生于山东省,曾经在著名作家学校鲁迅文学院培训。他的作品在很年轻的时候就颇受注意,在20岁时出版了第一本书。从18岁起,他先后为几个报刊担任记者和编辑工作,包括广州的《羊城晚报》。2000年,黄金秋获奖学金到马来西亚中央艺术学院学习新闻学。他以“清水君”作为笔名在中文新闻网《博讯》上发表文章,在海外中文网络社区中得以著名。他的文章被收集为两类:一类是非政治性的作品,以真名发表;另一类是政治评论,因为安全缘故以其笔名“清水君”发表。

在2001年初,黄金秋的文章开始引起了中国当局的注意。据报道,当局曾经派人找到他的父母,警告他们要关照黄金秋。2003年1月,黄金秋在《博讯新闻网》(Boxun.com)宣布他打算建立一个政党—-中华爱国民主党(CPDP),而引起当局对他更进一步的注意。尽管据说他的组党宣告引起了很多人的兴趣,但据认为中华爱国民主党并没有在实际上组织起来。2003年8月,黄金秋回到中国。根据他在旅途中继续发在《博讯新闻网》上的文章,自2003年8月15日起,他被国安秘密警察跟踪,先在云南,后在四川,一直到上海。2003年9月初,黄金秋回到山东省探访了父母亲,并于2003年9月10日发表了他的最后一篇文章《我和国安及朋友们》。黄金秋的亲属直到2004年1月才正式收到当局通知,他于2003年9月13日在江苏省连云港被拘捕。

黄金秋案于2004年6月22日在常州市中级人民法院以“颠覆国家政权” 罪开庭审判。据报道,法庭一度以证据不足而迟迟无法判决,但在检察院向法院补充新证据之后,黄金秋于9月27日被判决 “以中华爱国民主党筹委会负责人的身份,在互联网发表大量反动文章,组织、策划、实施颠覆我国国家政权”。他被判处有期徒刑十二年,现被监禁在江苏省常州看守所。黄金秋正就此判决提出上诉。

CHINA: Internet essayist, writer and journalist Huang Jinqiu (aka QingShuijun) sentenced to twelve years in prison on subversion charges for hiswritings.

The Writers in Prison Committee of International PEN protests the heavyprison sentence handed down to internet essayist, writer and journalistHuang Jingqiu (aka Qing Shuijun), who was sentenced to 12 years in prison on27 September 2004 on subversion charges for his writings. Huang Jinqiu hasbeen detained since 13 September 2003, and was held incommunicado untilJanuary 2004. International PEN considers Huang Jinqiu to be detained solelyfor the peaceful expression of his opinions, and therefore in contraventionof Article 19 of the United Nations Universal Declaration of Human Rights.We call for his immediate and unconditional release.

According to PEN’s information, leading internet essayist, writer andjournalist Huang Jinqiu was sentenced to twelve years in prison on 27September 2004 by the Changzhou Intermediate People’s Court on charges of’subversion of state power’ for a large number of essays published on theInternet. Huang has been detained since 13 September 2003, but his arrestwas not reported until mid-December 2003 and even then remained littlepublicised outside the Chinese-language media. His detention was notofficially acknowledged by the Chinese authorities until January 2004.

Huang Jingqiu was born in Shangdong Province in 1974, and trained at the LuXun Literature Institute, a leading writing school. His writings have beenwell-recognised from an early age, and at the age of twenty he published hisfirst book. He has worked as a journalist and editor of several newspapersand magazines since the age of eighteen, including the Guanzhou dailyYangcheng Wanbao. In 2000 he gained a scholarship to study journalism at theCentral Academy of Art in Malaysia, and became well known in the overseasChinese internet community for his essays published on the Chinese-languagenews website ‘Boxun.com’ under the pen-name Qing Shuijun (Mr Clear Water).These essays have been collected into two publications, one that isnon-politicaland published under his real name, and one collection of politicalcommentariespublished for security reasons under his pen-name Qing Shuijun.

In early 2001 his articles began to attract the attention of the Chineseauthorities, who reportedly visited his parents and warned them of theirconcerns about him. He attracted further attention in January 2003 byannouncing on Boxun.com his intention to found a political party, the ChinaPatriot Democracy Party (CPDP). Although his announcement is said to haveattracted a lot of interest, it is not thought that the CPDP was everorganised in practice. Later that year, in August 2003, he returned toChina, and according to his articles which he continued to post on Boxun.comthroughout his journey he began to be followed by the secret police on 15August 2003, first in Yunan Province, then in Sichuan and through toShanghai. In early September 2003, Huang Jingqiu visited his parents inShangdong Province; his last article was published on 10 September 2003,entitled ‘Me and My PublicSecurity Friends’. It was not until January 2004that his family was officially notified by the authorities of his arrest on13 September 2003 in Lianyungang, Jiangsu Province.

Huang’s trial began on 22 June 2004 at the Changzhou Intermediate People’sCourt on subversion charges. It is reported that the court was unable toreach a verdict initially because of lack of evidence, but after the casewas referred back to the prosecution further evidence was submitted and hewas convicted on 27 September 2004 of ‘organising, planning and performingsubversion of state power by publishing a large number of reactionaryarticles on the Internet in his capacity as member of the preparatorycommittee of the China Patriotic Democratic Party’. He was handed down atwelve-year prison sentence and is detained at Changzhou Detention Centre,Jiangsu Province. His is appealing the sentence.
