欧盟关注上海交大教师郭小军迫害案件

【大纪元2010年11月24日讯】欧洲联盟外交和安全政策高级代表凯瑟琳•艾什顿女男爵近日表示,欧盟已经向中共当局提出法轮功学员郭小军受迫害的案例,并将继续跟踪关注郭小军的情况。

艾什顿女男爵是在11月16日回复英国欧洲议会议员彼得•斯金纳的质询时作出上述表示的。

上海交大优秀青年教师郭小军,因修炼法轮功而遭受中共迫害。郭小军在2000年被非法判处五年徒刑,他的妻子也被劳教。今年1月,在上海世博会前的大规模迫害中,他再次被非法绑架,并于2010年7月6日被上海宝山区法院非法判刑四年。

谢谢您2010年10月8日的来信。从您的信中我得知,您选区的一位居民就中国法轮功学员郭小军先生的现况表示关注。

我一直密切地注意中国的人权状况,尤其是通过访问中国及会见中国领导人,还有一年两次的欧盟—中国人权对话。我对人权对话非常重视。

欧洲联盟坚定地致力于促进和保护宗教和信仰自由,这是欧盟人权政策的一部分。对任何形式的因宗教或信仰而对人不宽容的行为,欧洲联盟都予以谴责。欧盟在2009年11月的理事会决议中,再次提到了此问题。从这个角度看,欧洲联盟和您同样关注法轮功学员和其他宗教成员因宗教和信仰而在中国受到的迫害。欧盟通过双边政治对话、(当情况适合时)外交照会、公开声明,以及通过欧盟在联合国人权理事会或联合国大会第三委员会的行动,将宗教自由作为一项基本人权和宗教少数群体的权利加以关注。

欧盟已经向中国当局提出郭先生的案例,主要是通过在每次对话中向中国当局提交的关注个案清单。欧盟将继续跟踪他的情况。

您的来信还提到郭的多位律师受到的骚扰。欧盟对此采取了非常坚定的立场,必须保障律师能够在中国法律体系内发挥他们的作用,以保证中国公民享有自己选择律师进行辩护以及受到公正审判的权利。在过去的两年中,欧盟已数次向中国外交部和司法部提出这一问题。

Dear Peter,

Thank you for your letter of 8 October 2010 in which you bring to my attention the concerns of one of your constituents with respect to the situation of a Falun Gong practitioner in China, Mr Guo Xiaojun.

I continue to monitor China’s human rights situation closely, particularly in the context of my visits to China and meetings with the Chinese leadership, as well as through the bi-annual EU-China Human Rights dialogue to which I attach great importance.

The European Union has a strong commitment to promote and protect freedom of religion or belief as part of its human rights policy. The European Union condemns all forms of intolerance against persons because of their religion or belief, an issue the EU has again taken up in the Council Conclusions of November 2009. From this perspective, the European Union shares your concerns over the persecution on the basis of religion and belief of Falun Gong practitioners, as well as of members of other religions, in China. The EU addresses religious freedom as a fundamental human right as well as the rights of people belonging to religious minorities through its bilateral political dialogues, and, when appropriate, through demarches and public declarations and through EU action in fora such as the UN Human Rights Council or the Third Committee of the UN General Assembly.

The EU has raised the particular case of Mr Guo with the Chinese authorities, notably through the list of individual cases of concern submitted in the margins of each dialogue to the Chinese authorities, and will continue to follow his situation.

Your letter also refers to the harassment of Guo’s lawyers. The EU has taken a very firm stance on the need to ensure that lawyers are able to play their role within the Chinese legal system so as [to] ensure that Chinese citizens enjoy their right to being defended by a lawyer of their choice and receive a fair trial. The EU has raised this issue on several occasions in the last two years with the Ministry of Foreign Affairs and the Ministry of Justice.
