我們今天寫信給您，是因為中國作家、畫家嚴正學先生在中國被拘押，罪名是”顛覆國家政權罪”。
嚴先生於2006年10月18日被浙江省台州市公安局拘捕，並於11月1日以”顛覆國家政權罪”被正式起訴。台州市中級人民法院受理此案，目前嚴先生被關押在台州市路橋看守所。
看過法院文件的人表示，法院指控嚴先生涉嫌”秘密參加中國民主黨”、在海外網站上刊登”煽動性”文章、呼籲為已故的作家和異議人士劉賓雁捐款並參與溫嶺農會籌備圖謀”突破黨禁”。
我們相信，這些指控本身就是對嚴先生權利的侵犯。我們認為，對他的拘押違反了中國1998年簽署的《公民及政治權利國際公約》第19條。另外，中國本國《憲法》第35條規定：”中華人民共和國公民有言論、出版、集會、結社、遊行、示威的自由。”
參加另一個政黨怎可入罪！況且，嚴先生的律師李建強證實，嚴先生完全否認了他是中國民主黨成員的指控。
嚴先生案原定於2月14日開庭，但因他的律師要求取證而延期。
我們對嚴先生的命運深表關注。如果罪名成立，根據中國的《刑法》第105條和第106條，他將會被處以至少10年的有期徒刑。他現已64歲。
我們對嚴先生現狀有著最深切的憂慮，懇請您向中國政府提出此案並呼籲當局立即無條件釋放他。我們擔心，在中國這樣的政治環境中，嚴先生將得不到公正的審判。以往類似案件的經驗告訴我們，唯有國際壓力，才會使嚴先生獲得被釋放的機會。
嚴先生已經有過一次自殺，以抗議當局對他的抓捕和囚禁。我們擔憂，他會在絕望中再次自殺。

We are writing to you today regarding the Chinese writer and painter Mr YAN Zhengxue, who is being held in China on charges of “subverting state power”.
Mr YAN was arrested on 18 October 2006 by the Taizhou City Public Security Bureau of Zhejiang Province and was officially charged on 1 November 2006 with “subverting state power”. The case is now in the Taizhou City Intermediate People’s Court and Mr. YAN is held at the Taizhou City Luqiao Detention Centre.
According to individuals who have sighted the court documents, this charge is in connection with Mr YAN allegedly being “a secret member of the China Democratic Party”, publishing “inciteful” articles on overseas websites, calling for donations to a fund in honour of the writer and dissident LIU Binyan (now deceased), and giving advice to the Wenling Peasants Association on “breaking the ban on political parties”.
We believe the charges themselves to be a violation of Mr YAN’s rights. We regard him as being held in violation of Article 19 of the International Covenant on Civil and Political Rights – to which China became a signatory in 1998. In addition, Article 35 of China’s own Constitution stipulates: “Citizens of the People’s Republic of China enjoy freedom of speech, of the press, of assembly, of association, of procession and of demonstration.”
While it should not be a crime to be a member of an alternate poitical party, Mr YAN’s lawyer Mr LI Jianqiang attests that Mr YAN completely denies the charge that he is a member of the China Democratic Party.
Mr YAN’s trial was scheduled to begin on Feburary 14, but this has been deferred to allow his lawyer to collect evidence.
We are deeply concerned for the fate of Mr YAN. If found guilty, according to Articles 105 and 106 of Chinese Penal Code, he will be sentenced to a minimum of ten years in jail. He is now 64 years old.
We have the gravest fears for Mr YAN and ask you to raise his case with the Chinese government and call for his immediate and unconditional release. We are concerned that he will not be tried fairly in a court free from political influence. We also know from similar cases that it is only with international pressure that we have any chance of winning Mr YAN’s release.
Mr YAN has already attempted suicide once in protest against his arrest and incarceration. We fear he may do so again in desperation.
