中国:作家张林被判5年监禁

国际笔会狱中作家委员会对作家张林于2005年7月28日被判5年监禁和剥夺政治权利4年的消息感到震惊,认为对张林的这种重判直接侵犯了其受《联合国普遍人权宣言》第19条款保护的言论自由权,呼吁立即无条件地释放他。

今年2月,国际笔会狱中作家委员会对其99个国家中的会员发出警讯:异议作家、民主倡导者张林于2005年1月27日在安徽省蚌埠市火车站被捕,当时他刚从北京回来。他原计划到北京悼念2005年1月17日去世的已故改革派政治家赵紫阳。但当局不予允许,并强制他回蚌埠。

据报道,张林被捕是由于写了一系列“过激”文章发表在互联网上。1月29日张林被以“扰乱社会秩序”的罪名处罚拘留十五天,2月6日警察搜查了他的家﹔

而在2月12日,也就是其拘留即将到期的时候,他又被指控“涉嫌危害国家安全”而遭继续关押。

对张林的判决据报是由华东地区安徽省蚌埠中级人民法院于2005年7月28日做出的。当时没有正式宣布判决,直到5天后的8月2日,当事人可提出上诉的10天有效期过了一半时间后,才宣布向他的律师宣布。笔会了解到,张林正在提出上诉。

张林是安徽省蚌埠市人,多年来积极投入民主运动,写了大量关注中国政治和人权问题的文章。因为他的政治行为,张林曾反复多次地被投入监狱。

China: Writer Zhang Lin Sentenced to Five Years in Prison

The Writers in Prison Committee of International PEN is shocked by the news that writer Zhang Lin was sentenced to five years in prison and four years deprivation of political rights on 28 July 2005. It protests this heavy sentence passed against Zhang in direct violation of his right to freedom of expression as guaranteed under Article 19 of United Nations Declaration on Human Rights. It calls for his immediate and unconditional release.

In February this year, PEN’s Writers in Prison Committee, alerted its membership of writers based in 99 countries that Zhang Lin, a dissident writer and pro-democracyadvocate, had been arrested on 27 January 2005 at Bangbu City railway station in Anhui Province. At the time of his arrest, Zhang Lin had just returned from a trip to Beijing where he planned to pay his respects to the late Zhao Ziyang, a reformist politician who had died on 17 January 2005. Zhang Lin was not permitted to do so by the authorities and was forced to return to Bangbu.

According to reports, Zhang Lin was arrested because of a number of “radical” articles he had written and subsequently posted on the internet. On 29 January, Zhang Lin was charged with “disturbing social order”, and placed in detention for 15 days. His house was searched by police on 6 February. On 12 February, shortly before he was due to be released, he was charged with “suspicion of endangering national security”.

Zhang Lin was reportedly sentenced on 28 July 2005 by the Bangbu Intermediate People’s Court, Anhui Province, in eastern China. The verdict was not formally announced, not even to his lawyer, until five days later on 2 August, effectively halving the 10 day limit under which a person can appeal their conviction. PEN understands that Zhang Lin is nevertheless filing an appeal.

Background

Zhang Lin is from Bangbu, Anhui Province. He has been active in pro-democracy movements for many years and has written numerous essays on politics and human rights issues with a special focus on China. He has been imprisoned repeatedly for his political activities.

Recommended Actions:

Please send appeals:

– Protesting the five year sentence and four years deprivation of political rights passed against Zhang Lin;
– Pointing out that not only is his detention in violation of the Universal Declaration on Human Rights, but also Article 19 of the International Covenant on Civil and Political Rights that specifically guarantees the right to freedom of expression to which the People’s Republic of China became a signatory in 1998;
– Therefore calling on the government of the People’s Republic of China to stand by its commitments and that Zhang Lin, be freed immediately and without conditions.
